The situation
A cross-border consumer electronics seller was notified by Amazon Product Safety that all listings for its S9 ear-care device were removed for alleged "substantial product hazard" concerns. The impact was immediate:
- 20+ ASINs deactivated
- $385,000 of FBA inventory scheduled for disposal
- Funds at risk of being withheld
- 30-day deadline to remove inventory
- First appeal denied the same day it was submitted
The seller had already submitted UL 859, IEC 62133-2, UN38.3, FCC, CPSIA, CE and ISO/IEC 17025 documentation. Amazon maintained its position. With inventory destruction imminent and internal appeals exhausted, the seller retained U.S. counsel.
What we did
Compliance reconstruction — We reorganized all safety documentation to directly address Amazon's policy language rather than merely submitting technical reports. Every report was mapped to the specific Amazon requirement it satisfied.
Battery safety defense — We demonstrated the battery was a permanently embedded lithium polymer cell (230mAh / 0.85Wh), compliant with UN38.3, with OTA firmware temperature safeguards. Disassembly images and circuit diagrams substantiated every claim.
Proactive corrective actions — Even without confirmed defects, we implemented 100% battery inspection (up from 70% sampling), 48-hour aging tests, enhanced PDP safety warnings, and app-based safety reminders.
Review pattern analysis — We identified 178 abnormal negative reviews over 12 months, 21 of which were safety allegations later removed by Amazon, with patterns suggesting coordinated activity.
BSA Section 18 arbitration — We filed a formal arbitration demand requesting inventory quarantine instead of destruction, release of held funds, and recognition of the seller's compliance history since 2021.
