The situation
In April 2026, a cross-border seller received a U.S. utility patent complaint on the Amazon U.S. marketplace. Two ASINs were removed. The patent covered a pet transportation platform structure, and the client's product — a pet trolley — had certain functional overlap.
Platform notification stated: listings removed, violation records retained up to 180 days, multiple IP complaints could trigger account suspension, and reinstatement required either a court order, rights holder retraction, or a non-infringement explanation.
Without determining whether the product fell within the scope of the patent claims, appeals would fail, rights-owner communications would lack technical foundation, and future product iterations could continue facing complaints.
What we did
1. Full claim structure breakdown — We analyzed every independent claim element-by-element: core structural combinations, fixation mechanisms, folding mechanisms, and wheel configurations. The patent's actual protection focused on specific combinations — not broadly on "pet trolleys" as a category.
2. Claim chart analysis — Detailed element-by-element comparison revealed key differences: different wheel configuration, different fastening method (no wrap-around hook-and-loop), no mating fastening system, no specific rotational locking mechanism, no ultra-thin folding structure. Multiple required claim elements were absent. No literal infringement.
3. Dual-track response — We prepared a structural non-infringement explanation for platform appeal and rights-owner communication grounded in technical distinctions rather than abstract legal argument.
4. Design-around recommendations — Even with low risk, we advised reinforcing distinctions and developed a differentiated innovation roadmap: new quick-release fastening systems, enhanced omnidirectional mobility, modular platforms, shock-absorption improvements, and alternative folding geometries.
