Preliminary Injunction vs TRO
A preliminary injunction is a longer-lasting court order that requires a hearing. While a TRO is issued ex parte (without the defendant), a preliminary injunction hearing allows both sides to present evidence.
Timeline
The preliminary injunction hearing is typically scheduled 14-21 days after the TRO is issued. If the defendant fails to appear, the court may convert the TRO to a preliminary injunction and eventually enter a default judgment.
