Ex Parte Proceedings
Ex parte means 'from one side only.' In TRO cases, the plaintiff asks the court to issue the order without notifying the defendant. The court can do this if the plaintiff demonstrates:
- Irreparable harm would occur if the defendant were notified first
- The plaintiff is likely to succeed on the merits
- The balance of hardships favors the plaintiff
